Welcome to Glow Heroes!

Glow Heroes, and the glowheroes.com website (collectively, the “Site”), are owned and operated by Glow Heroes LLC (“Glow Heroes,” “we,” “us,” or “our”). Our Site offers a convenient way to learn about and purchase our children’s creative play products, including the Draw with Light sets and related accessories (the “Products”).

These Terms of Service together with our Privacy Policy and Cookie Policy (collectively, the “Terms”) govern your use of the Site and any content, functionality, or services offered on or through the Site (the “Services”).

Acceptance of These Terms

Please read these Terms carefully. By accessing or using the Site or Services, or by clicking to accept or agree to the Terms when that option is presented, you agree to be bound by these Terms, including our Privacy Policy. If you do not agree, do not use the Site or Services.

We may update these Terms from time to time. All changes are effective when posted and apply to all access and use thereafter. Your continued use of the Site confirms your acceptance of the revised Terms.

Eligibility and Appropriate Use

You must be at least 18 years old to make purchases on the Site. The Site is directed to adults, parents, and guardians. We do not knowingly collect personal information from children under 13. If you are under 18, you may only use the Site with the involvement of a parent or legal guardian.

You agree to comply with all applicable local, state, national, and international laws and regulations when using the Services. We may modify or discontinue any part of the Services or Products at any time without notice.

Account Registration

You may be required to create an account to use certain features. You are responsible for safeguarding your account credentials and for all activities under your account. We may, in our sole discretion, refuse, reclaim, or change a username that is inappropriate or otherwise objectionable.

User Content and Reviews

You and other users may submit content such as photos, videos, comments, questions, testimonials, and reviews (collectively, “User Content”). You are solely responsible for your User Content.

By submitting User Content, you grant Glow Heroes a worldwide, nonexclusive, perpetual, irrevocable, royalty‑free, transferable and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in any media, for any lawful purpose. You waive any moral rights to the extent permitted by law. We may edit or remove User Content at any time, but we are not obligated to do so.

You represent and warrant that you own or control all rights in your User Content, that it is accurate, and that our use of it will not violate any rights of third parties or any laws.

Review Guidelines

When posting reviews, you agree that: (1) you have firsthand experience with the Product, (2) you will not post offensive, unlawful, or discriminatory content, (3) you will not post false or misleading statements, and (4) you will not coordinate review campaigns. Reviews do not reflect our opinions, and we are not liable for any review content.

Intellectual Property

All content on the Site, including text, graphics, images, videos, logos, icons, software, and other materials, is owned by Glow Heroes or our licensors and is protected by intellectual property laws. You may not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works from, or exploit any part of the Site or its content without our prior written permission, except as allowed by law for personal, noncommercial use.

Purchases, Pricing, and Payment

If you purchase Products through the Site, you agree to provide current, complete, and accurate information. You authorize us to charge your selected payment method for the total amount of your order, including applicable taxes, shipping, and handling.

Accepted payment methods: major credit and debit cards, Shop Pay, Apple Pay, Google Pay, and PayPal. Availability may vary.

All prices, discounts, promotions, and availability are subject to change without notice. We reserve the right to refuse or cancel any order, limit quantities, and require additional verification before accepting an order.

The display of a Product on the Site is an invitation to make an offer. Your order is your offer to buy, which we may accept at our discretion by confirming shipment. If a Product is listed at an incorrect price, we may cancel any orders placed for that Product and, if applicable, issue a refund.

Product Information and Safe Use

Our Products are designed for creative play. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or condition. Always read and follow all instructions, warnings, and age recommendations on packaging and on the Product page. Inspect Products and accessories regularly for wear and damage, and stop use if any part appears damaged.

Colors and finishes may vary based on your device settings. Packaging and included accessories may vary. Measurements and weights are approximate.

Children should use our Products only under adult supervision. Do not shine UV light into eyes, and avoid prolonged direct exposure to skin. Keep small parts away from children under 3 years of age.

Shipping and Delivery

We process orders on business days, excluding holidays. Processing times are separate from carrier transit times. Delivery estimates are not guaranteed.

United States: Orders ship from the United States. We typically use USPS, UPS, DHL, or FedEx at our discretion. We may not be able to ship to P.O. boxes or APO/FPO addresses for certain methods.

International: International shipping availability and rates may vary by country. Duties, taxes, and fees are the customer’s responsibility unless otherwise stated at checkout.

Risk of loss transfers to you upon our delivery of the package to the carrier.

Returns, Refunds, and Exchanges

Please review your order before completing your purchase.

Damaged or defective items: If your item arrives damaged or defective, contact us within 7 days of delivery with your order number, a description, and photos. We will repair, replace, or refund at our discretion.

Unopened returns: For most Products purchased directly from us online, we accept returns of unopened, unused items in original packaging within 14 days of delivery. You are responsible for return shipping unless the return is due to our error. We may refuse returns that do not meet these conditions.

Refund timing: Refunds are issued to the original payment method after we receive and inspect the returned item. Your bank or card issuer controls when the credit appears.

Third‑party purchases: If you purchased through another retailer or marketplace, their policies apply.

Undeliverable shipments: If a shipment is returned to us as undeliverable, we may deduct a reasonable return‑shipping and processing fee from any refund.

Promotions and Coupons

Promotions, bundles, and coupon codes are subject to individual terms. Unless stated otherwise, promotions cannot be combined, are not valid on prior purchases, have no cash value, and may exclude bundles, gift cards, and limited items. We may modify or end promotions at any time.

Prohibited Conduct

You agree not to:

  • Post unlawful, harmful, misleading, infringing, defamatory, obscene, or otherwise objectionable content,

  • Violate the rights of others, including privacy and intellectual property rights,

  • Upload viruses or malicious code, interfere with or disrupt the Site or networks,

  • Attempt to gain unauthorized access to the Site or accounts,

  • Use the Site for commercial solicitation or spam,

  • Impersonate any person or entity, or misrepresent your affiliation,

  • Engage in any activity that violates laws or these Terms.

We cannot guarantee that other users will comply with these rules, and you assume any associated risks.

Third‑Party Links and Services

The Site may contain links to third‑party sites or services for your convenience. We do not control, endorse, or assume responsibility for third‑party content or practices. Your use of third‑party sites is at your own risk and subject to their terms and policies.

Disclaimers

The Site, Services, and all content and materials are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, and non‑infringement, as well as any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be error‑free or uninterrupted, or that defects will be corrected.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

Limitation of Liability

To the fullest extent permitted by law, Glow Heroes and our officers, directors, employees, agents, service providers, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Site, Services, or Products, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to the Site, Services, or Products will not exceed the amount you paid to us for the Product or Service at issue in the six months preceding the event giving rise to the claim.

Some jurisdictions do not allow limitations of liability, so some of the above may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Glow Heroes and our officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Site or Services, your User Content, or your violation of these Terms or applicable law.

Electronic Communications

You consent to receive communications from us electronically, including emails, notices posted on the Site, and messages through your account. You agree that such communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Miami‑Dade County, Florida for any disputes arising out of or relating to these Terms or the Services.

Any cause of action must be filed within one year after the claim arises.

No Waiver and Severability

Our failure to enforce any provision of these Terms is not a waiver of that provision. If any provision is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
